Introduction

These Terms of Service apply to your access to and active use of https://fedichat.org, its APIs and sub-domain services (we, us, the website, Fedichat.org) as well as all other properties and services associated with Fedichat.org.

Read our Terms of Service carefully before using this website ("the website" "Fedichat.org"). These Terms of Service ("the Terms of Service" or "the document") govern your access to and use of the website. The website is available for your use only on the condition that you agree to the Terms of Service set forth above and below. If you do not agree with all of the Terms of Service, then do not access or use Fedichat.org. By accessing or using the website, you and the entity you are authorized to represent ("user" "you" or "your") signify your agreement to be bound by the Terms of Service.

To reflect and respect developments on applicable law and on the website itself, this document will be updated periodically.

Regarding This Document

The Terms of Service provided by Fedichat.org, together with any additional documents and/or terms they actively adopt through referencing, collectively constitute the legal document this page serves to provide, and is entered into by and between Fedichat.org and all its users (you).

This document contains essential knowledge regarding your rights and obligations, as well as conditions, limitations and exclusions that apply to your use of and access to Fedichat.org.

User Responsibilities

By agreeing to this section of the document, you accept that:

1. You may only use Fedichat.org if you can clearly understand and actively comply with the terms laid out on this page.
2. You were not permanently banished from the website in the past.
3. You are responsible for your own experience on the website. Fedichat.org is not responsible for your individual experience.

Furthermore, you confirm that you are not under 18 or that you are at least of the regulated minimum age defined by your local legislation.

Reporting Users and Content

1. Only report content that violates the rules defined in the Terms of Service, or content that violates the rules of the community it was posted to.
2. Personal messages may be reported if they violate any of the terms defined in this document.
3. User profiles may be reported by sending an e-mail to matrix@fedichat.org.

Content Policy (Rules for Users)

To keep a civil environment for our users to interact with, provided posts and comments follow the rules laid out below.

1. Attacks on Users or Groups

Before using the website, remember you will be interacting with actual, real people and communities. Fedichat.org is not a place for you to attack other people or groups of people. Discuss ideas and be critical of principles. Show the respect you desire to receive.

We do not tolerate threats of and calls for violence in any form against any living creature.

1.1 Attacks on Users

Everyone has a right to interact with Fedichat.org and other federated instances free of harassment and/or threats of violence. Please be kind and civil to your fellow human. Trolling users is only funny if both parties find it funny.

1.2 Discrimination Against Minority / At-Risk Groups

Fedichat.org specifically forbids any sort of discrimination against any group on this site. Any form of racism is also forbidden. As already stated in Section 1, calls for violence against minority or at-risk groups can result in a site-wide ban. We also reserve the right to report the offending user(s) to their local law enforcement unit responsible for hate crimes.

2. Respecting the Privacy of Other Users (no Doxing)

Always be respectful of the privacy of others who access and use the website. Never harass or threaten to harass people by revealing personal information (doxing) or any type of media. Sharing sensitive information or media belonging to or depicting a person or entity (other than yourself) is only allowed on the condition that you have their explicit consent, or that it is publicly available information or media served in compliance with our content policy.

2.1 Privacy (Exceptions)

Information that is public domain can be shared, provided it is in good faith. For example, the email address of a government official you disagree with and wish to have a write-in email campaign.

This does not however permit you to harass them or conduct any activities that would be considered illegal, either under the laws local to the person in mention or under the laws that govern Fedichat.org.

You may also not use any services we provide to "witch-hunt" individuals, even if their information is public.

2.1.1 User Data Retention

3. System Disruption

You may not engage in any activities that may interfere with the normal use of, or access to, Fedichat.org. We reserve the right to permanently revoke access to any entities and/or individuals, that cause either service disruption or threaten the security of our site and/or users. This includes evading network-level blocking, such as WAF or IP-based blocking/bans. We also reserve the right to report all infractions of cyber-security law to relevant law enforcement entities.

3.1 Meta-Discussion

Publicly discussing methods of evading security measures relating to Fedichat.org, or any property controlled by Fedichat.org, is not allowed, and can result in up to a permanent site-wide ban for all parties involved.

3.2 Exceptions

Users are allowed to use any provided method to interact with Fedichat.org, as long as it is in good faith. VPN and/or Tor access is not explicitly disallowed, however, we reserve the right to restrict and/or limit types of access via anonymizing services to protect our site.

3.3 Reporting Exploits

Please report any security exploits to matrix@fedichat.org, as per our Vulnerability Disclosure Policy at https://fedichat.org/security. You may also encrypt your message by using the key file at https://fedichat.org/contact-encryption.txt.

4. Illegal Content

Do not post illegal content of any type. Do not engage in any activity that may encourage, facilitate or provide access to illegal transactions. Do not share or encourage the sharing of abusive or sexually suggestive content involving real or fictional minors. This also includes drawn, animated, generated and other content that does not depict real minors. Any violent or otherwise inappropriate behavior involving a minor will also always be strictly prohibited.

4.1 Piracy

Meta discussion of piracy and related topics is allowed. This includes:

1. News about file sharing or streaming platforms
2. Software used for streaming, downloading or sharing content
3. Laws concerning piracy in different regions/countries
4. Moral or ethical views on piracy
5. Discussion about releases themselves, as long as no content listed below is included

What is NOT allowed:

1. Links to copyright infringing content, such as
1.1 a copyright infringing YouTube video
1.2 a torrent file or magnet link leading to copyright infringing content
1.3 HTTP or FTP links to downloads copyright infringing content
1.4 unlicensed streaming sites for copyrighted content
2 Links to services actively facilitating copyright infringement
2.1 This includes popular sites that can be found on the first page of most search engines.
2.2 Posting obfuscated variants of the above, such as
2.2.1 embedding links, domains or instructions in an image
2.2.2 encoding things in Base64

We reserve the right to both remove/block any offending communities and permanently ban any offending users to protect the site from any potential legal threats, as a precautionary measure.

We evaluate all copyright related takedown notices we receive. Provided they are submitted in good faith and by the copyright holder, we will take infringing content down. We may err on the side of caution in these cases due to the associated legal risks if our assessment is incorrect.

4.2 Copyright Takedown Notice Compliance

In order for Fedichat.org to comply with any copyright related takedown requests you MUST provide ALL of the following:

Full legal name of either the individual or organization
E-mail where you can be reached at
Registered mailing address of legal agent
Phone number where you may be reached at
Description of infringing material
URL Linking to the material you wish to have removed

Please note, while Fedichat.org may be able to remove the content hosted by our service, we are usually not able to enforce removal on any federated services, as we do not control and/or own them.

Failure to provide ALL of the above REQUIRED information will result in Fedichat.org disregarding the request.

5. Individual Communities and Rooms

Your participation in individual communities and rooms will only be acceptable on the condition that you abide by their rules. Always post compliant content that upholds the rules of the individual community and the website, and is of personal interest to you.

5.1 Community Manipulation

Do not engage in content manipulation such as posting spam content or vote manipulation through the use of several user accounts.

6. Violent Content

No visual content depicting executions, murder, suicide, dismemberment, visible innards, excessive gore, or charred bodies is allowed on Fedichat.org. No content depicting, promoting or enabling animal abuse is allowed on our site. No erotic or otherwise suggestive media or text content featuring depictions of rape, sexual assault, or non-consensual violence is allowed on Fedichat.org. All other violent content should be tagged NSFW.

6.1 War Footage

Any graphic war footage taken by either private individuals or media outlets is prohibited. Exceptions may be made for photos and videos of historical significance.

6.2 Violent content (exceptions)

Depictions, imagery or otherwise ancient artwork in any form, other publicly available media entertainment content depicting gore or sexual content may be excluded and allowed, as long as they are fair use, in the public domain, or tolerated by the copyright owner, and in compliance with our Content Policy, as well as all applicable laws and other local legislation.

7. Advertising

Fedichat.org is a free service, funded by donations and run by volunteers for the benefit of its users. As such, it is not intended to be used as a marketing channel for extensive commercial advertising or product promotion. Promoting or recommending products and services is generally allowed provided that the following criteria are met:

1. It is relevant to the community where it is posted.
2. It offers something of value to our users.
3. It is created for community engagement rather than being a one-way message directed at users.

Users or communities which primarily promote paid products or services, with little other engagement on Fedichat.org, may have their content removed and may be banned. This includes personal promotion such as a GoFundMe drive, OnlyFans page, or blog.

8. Misinformation

In general we hope that the users will post information that THEY believe is true and helpful, but sometimes this information can be harmful to others. This is technically already covered by our rules under Section 1, but we want to clarify this more, especially when it comes to more serious matters.

Users should always do their own research beyond just the first few pages of their favourite search engine, or what they read posted to online communities, even such as ours. Harmful information, such as intentional and targeted political misinformation attacks, will be deleted and the users responsible will be banned.

We DO reserve the right to remove any information posted which COULD cause imminent PHYSICAL harm to any living being.

This DOES INCLUDE topics such as:
1. Conversion therapy
2. Unhealthy diets, e.g. due to insufficient nutrients
3. Frontal lobotomies

We also reserve the right to remove any sufficiently scientifically proven MALICIOUS information posted which a user may follow, which would result in either IMMINENT PHYSICAL harm to an INDIVIDUALS PROPERTY, the PROPERTY of OTHERS or OTHER LIVING BEINGS.

For example, recommending that someone microwave a battery to "recharge" it. This will result in the destruction of the battery and/or microwave, including potential direct harm to the operator.

Legal Factuality Requirements

The content provided on Fedichat.org is not necessarily factually true, and hosting it does not mean agreeing, supporting or encouraging it. The content posted must at minimum comply with our Terms of Service and any other documents that are mentioned and linked to in this document.

Our Rights

You are solely and entirely responsible for your use of the website and your computer, internet, and data security.

You waive Fedichat.org and its owner, subsidiaries, affiliates, and all their respective staff, representatives, service providers, contractors, licensors, licensees, and successors from any claims resulting from any action taken by Fedichat.org, and any of the foregoing parties relating to any investigations by either us or by law enforcement authorities.

In the case of a violation of the Terms of Service, here is what may happen:

1. Removal of the violating content, and asking you to not repeat it.
2. Being warned for the second time, and having your account temporarily suspended.
3. Adding temporary or permanent limitations to Fedichat.org communities and rooms, such as applying NSFW tags or restricting the posting of new content by users.
4. Removal of all content associated with the violating party.
5. Banishing of communities and rooms.
6. Permanent banishing of user accounts.

Bot Usage and Guidelines

1. Bots shall not be used for any kind of advertising.
2. The bot accounts must be marked as a bot. Both in the bio and by marking the account as a bot.
3. The owner of the bot and contact details must be mentioned in the bot's bio.
4. Bots are only allowed to post in communities or rooms where they have explicit permission from the community's owners to do so.
5. Bots from other instances that post in Fedichat.org communities or rooms must follow the same rules.
6. Bots shall not be "spammy", as in multiple posts per minute.
7. Breaking any of these rules will result in a ban for the Bot and, if required, its owner.

Our Governing Laws

The website and the agreement will be governed by and construed per the laws of the following countries and/or states:

Federal Republic of Germany

In the case of having to face an event not covered by the Terms of Service, the full body of this document will still keep its validity and use. In this event, the laws applicable to us, which were mentioned in the above list of countries and/or states, will be used as a primary guide in content moderation.

Should any section of the Terms of Service be held invalid or unenforceable, that section shall be construed consistent with applicable law and all of the remaining sections shall remain in full force and effect.
